1. General

i. This document is an electronic record in terms of Information Technology Act, 2000 and rules made there under pertaining to electronic records. This electronic record is generated by a computer system and does not require any physical or digital signatures.

ii. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 which require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of any website in India

iii. The use of this website is solely governed by this Privacy Policy and the Terms of Use of this Website. Visiting the Website and/or using any services provided on this Website shall be construed as acceptance of the Privacy Policy and the Terms of Use by the user and that the user agrees to be bound by the same.

iv. The user fully understands and agrees that the Privacy Policy and the Terms of Use constitutes a legal binding agreement between the users and owners of the website. The user shall be subject the rules, guidelines, terms and conditions applicable to the services provided by the Website.

2. Information collection and storage

i. We at Advisorate are committed to ensuring that the user’s privacy is protected. The information is provided voluntarily by the user. The information so collected is used solely for the following purpose:

– Record keeping

– Procession payments

ii. We collect the following information:

(ii) The User is aware that Advisorate may disclose personal information if required to do so by law or if it is believed in good faith that such disclosure is reasonably necessary to respond to subpoenas, court orders or other legal processes. The Website (“Advisorate”) may also disclose the User’s personal information to law enforcement offices, third party rights owners, or other third parties if it believes that such disclosure is reasonably necessary to enforce the Terms or Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of its users, or the general public.

6. Advertisements/ Promotions by Third Parties

The User is aware that the Website uses third-party advertising companies to serve ads to the users of the Website. The User is aware that these companies may use information relating to the User’s visits to the Website and other websites in order to provide customized advertisements to the User. Further, the Website may contain links to other websites that may collect personally identifiable information about the User. The Website is not responsible for the privacy practices or the content of any of the aforementioned linked websites, and the User expressly acknowledges the same and agrees that any and all risks associated will be borne entirely by the User.

7. User’s Consent

By using the Website and or by providing information through the Website, the User consents to the collection and use of the information disclosed by the User on the Website in accordance with this Policy, including but not limited to the User’s consent towards sharing/divulging the User’s information, as per the terms contained hereinabove.

8. Interruption in Services

Advisorate shall not be liable for any loss or liability resulting, directly or indirectly, from delays or interruptions due to electronic or mechanical equipment failures, telephone interconnects problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes.

9. Dispute Resolution and Jurisdiction

It is expressly agreed to by the Parties hereto that the formation, interpretation and performance of this Policy and any disputes arising here from will be resolved through a two-step Alternate Dispute Resolution (“ADR”) mechanism. It is further agreed to by the Parties that the contents of this Section shall survive even after the termination or expiry of the Policy and/or Terms.
Mediation: In case of any dispute between the parties, the Parties will attempt to resolve the same amicably amongst themselves, to the mutual satisfaction of both Parties. In the event that the Parties are unable to reach such an amicable solution within sixty (60) days of one Party communicating the existence of a dispute to the other Party, the dispute will be resolved by arbitration, as detailed hereinbelow;

Arbitration: In the event that the Parties are unable to amicably resolve a dispute by mediation, said dispute will be referred to arbitration by a sole arbitrator to be appointed by Advisorate, and the award passed by such sole arbitrator will be valid and binding on both Parties. The Parties shall bear their own costs for the proceedings, although the sole arbitrator may, in his/her sole discretion, direct either Party to bear the entire cost of the proceedings. The arbitration shall be conducted in English, and the seat of Arbitration shall be in the city of Bangalore in the state of Karnataka, India.

10. Changing the Privacy Policy

Advisorate has the discretion to update this privacy policy at any time. Users are encouraged to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.
